What is a personal injury case?
A personal injury case happens when someone has a “duty of care” to you but fails in that duty, and that failure goes on to cause you injury.
For example, every driver has a duty of care to every other driver. When you get behind the wheel of a car you are pledging that you will obey the traffic laws, that you will be attentive, and that you will do everything in your power to prevent an accident.
A landlord has a duty of care to tenants, employees, and guests. Their duty of care says that they will keep their premises in good working repair, eliminating hazards in a timely fashion and posting warnings if they can’t rectify the hazard right away.
